The Book on Legal Punishments (Al-Hudud)
حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، حَدَّثَنَا هَمَّامٌ، عَنِ الْقَاسِمِ بْنِ عَبْدِ الْوَاحِدِ الْمَكِّيِّ، عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ، أَنَّهُ سَمِعَ جَابِرًا، يَقُولُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم
إِنَّ أَخْوَفَ مَا أَخَافُ عَلَى أُمَّتِي عَمَلُ قَوْمِ لُوطٍ
Narrated Jabir: That the Messenger of Allah (ﷺ) said: "What I fear most from my Ummah is the behavior of the people of Lut."
حَدَّثَنَا أَحْمَدُ بْنُ عَبْدَةَ الضَّبِّيُّ الْبَصْرِيُّ، حَدَّثَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ، حَدَّثَنَا أَيُّوبُ، عَنْ عِكْرِمَةَ، أَنَّ عَلِيًّا، حَرَّقَ قَوْمًا ارْتَدُّوا عَنِ الإِسْلاَمِ، فَبَلَغَ ذَلِكَ ابْنَ عَبَّاسٍ فَقَالَ لَوْ كُنْتُ أَنَا لَقَتَلْتُهُمْ، لِقَوْلِ رَسُولِ اللَّهِ صلى الله عليه وسلم
مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ
Narrated 'Ikrimah: That 'Ali burnt some people who apostasized from Islam. This news reached Ibn 'Abbas, so he said: "If it were me I would have killed them according to the statement of Messenger of Allah (ﷺ). The Messenger of Allah (ﷺ) said: 'Whoever changes his religion then kill him.' And I would not have burned them because the Messenger of Allah (ﷺ) said: 'Do not punish with the punishment of Allah.' So this reached 'Ali, and he said: "Ibn 'Abbas has told the truth."
حَدَّثَنَا أَبُو كُرَيْبٍ، وَأَبُو السَّائِبِ، سَلْمُ بْنُ جُنَادَةَ قَالاَ حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ بُرَيْدِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي بُرْدَةَ، عَنْ جَدِّهِ أَبِي بُرْدَةَ، عَنْ أَبِي مُوسَى، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ
مَنْ حَمَلَ عَلَيْنَا السِّلاَحَ فَلَيْسَ مِنَّا
Narrated Abu Musa: That the Prophet (ﷺ) said: "Whoever carries weapons against us, he is not from us."
حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ، عَنِ الْحَسَنِ، عَنْ جُنْدَبٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم
حَدُّ السَّاحِرِ ضَرْبَةٌ بِالسَّيْفِ
Narrated Jundab: That he heard the Messenger of Allah (ﷺ) saying: "The punishment of the Sahir is a strike of the sword."
حَدَّثَنَا مُحَمَّدُ بْنُ عَمْرٍو السَّوَّاقُ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ صَالِحِ بْنِ مُحَمَّدِ بْنِ زَائِدَةَ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، عَنْ عُمَرَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ
مَنْ وَجَدْتُمُوهُ غَلَّ فِي سَبِيلِ اللَّهِ فَاحْرِقُوا مَتَاعَهُ
Narrated Umar: That the Messenger of Allah (ﷺ) said: "Whomever you find stealing from the spoils of war while in the path of Allah, then burn his belongings." Salih (one of the narrators) said: "I entered upon Maslamah and with him was Salim bin 'Abdullah. There was a man there who had stolen from the spoils of war, so Salim narrated this Hadith. So he ordered accordingly, and his belongings were burnt. There was a Mushaf in his belongings, so Salim said: 'Sell this and give its proceeds as charity.'"
حَدَّثَنَا مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا ابْنُ أَبِي فُدَيْكٍ، عَنْ إِبْرَاهِيمَ بْنِ إِسْمَاعِيلَ بْنِ أَبِي حَبِيبَةَ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ
إِذَا قَالَ الرَّجُلُ لِلرَّجُلِ يَا يَهُودِيُّ فَاضْرِبُوهُ عِشْرِينَ وَإِذَا قَالَ يَا مُخَنَّثُ فَاضْرِبُوهُ عِشْرِينَ وَمَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ فَاقْتُلُوهُ
Narrated Ibn 'Abbas: That the Prophet (ﷺ) said: "If a man says to another man: 'O you Jew' then beat him twenty times. If he says: 'O you effeminate' then beat him twenty times. And whoever has relations with someone that is a Mahram then kill him."
حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، عَنْ بُكَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الأَشَجِّ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ جَابِرِ بْنِ عَبْدِ اللَّهِ، عَنْ أَبِي بُرْدَةَ بْنِ نِيَارٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم
لاَ يُجْلَدُ فَوْقَ عَشْرِ جَلَدَاتٍ إِلاَّ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ
Narrated Abu Burdah bun Niyar: That the Messenger of Allah (ﷺ) said: "No one is to be lashed more than ten lashes except for a legal punishment among Allah's punishments."
